The Court of Appeal has reversed Akuapem Poloo’s 90-day jail term after her lawyers filed an appeal on Monday December 6, 2021.
Instead of the jail sentence a fine of GHc12, 000 (1000 penalty) has been imposed on her.
This comes after the High Court in Accra, on December 1, 2021, ordered Ghanaian showbiz personality to continue her jail term in her case involving the publication of a nude photo of her son.
The court dismissed an earlier appeal filed by Akuapem Poloo which sought to plead for clemency on the 90-day jail term handed to her by the Accra Circuit Court on April 16, 2021.
Justice Ruby Aryeetey presiding, held that the sentence as handed down by an Accra Circuit Court last April was not, on the face of it, excessive and would thus not be interfered with.
However, in the second appeal filed by Poloo’s lawyers, they insited that the 90-day jail sentence was too harsh.
“Please take note that the convict/appellant/appellant hearin, being aggrieved by the judgement of the High Court Criminal Division (1)Accra, Her Ladyship Ruby Aryeetey dated 1st December 2021 dismissing the appellant appeal against the conviction and sentenced to 90 days imprisonment imposed on the appellant on each count to run concurrently by Her Honour Mrs Christiana Cann dated April 16, 2021 hereby appeals to the court of appeal on the grounds set out below and for the release stated hereunder.
That the learned judge erred in failing to appreciate that as a young first offender and a single parent, a noncustodial sentenced of a fine instead of a custodial sentence of 90days imposed on the appellant by the trial court is appropriate in this case,” the statement reads.
Akuapem Poloo was handed a 90-day jail term for publishing obscene material and violating the dignity and integrity of her seven-year-old son in a nude photo she posted on social media.
