The Attorney-General has entered a nolle prosequi in the high-profile case of The Republic v. Kwabena Duffour and seven Others, effectively discontinuing prosecution against the former Finance Minister and his co-accused.
The case, which dates back to 2020, was part of Ghana’s sweeping financial sector clean-up initiated in 2018. It aimed to tackle alleged mismanagement and impropriety in the banking and finance industries, with Duffour and associates accused of actions that reportedly led to significant financial losses for the State.
In a press release signed by Deputy Attorney-General, Dr. Justice Srem-Sai, the ministry outlined that the decision to withdraw the charges stems from the accused persons having met the government’s recovery threshold.
“The Office of the Attorney-General… established a threshold of 60% recovery of the alleged losses to the State,” the statement read. Following prolonged negotiations, the threshold was met.
“This decision… does not imply an absence of wrongdoing,” the release stressed. Rather, it was described as a pragmatic measure prioritizing public interest over continued prosecution, given the significant restitution achieved.
