Ground Up Chale clarifies contract, rights dispute with Kwesi Arthur

Jonathan K. Amable, lawyer for Ground Up Chale, has addressed ongoing disputes between rapper Kwesi Arthur and the label, shedding light on contractual and intellectual property issues that have been widely circulated online.

This follows growing discussions on social media regarding the dynamics between artistes and record labels in Ghana’s music industry, stemming from Kwesi Arthur’s claims that the label was infringing on his rights.

According to the label’s lawyer during an X Space session by Joy Entertainment hosted by Kwame Dadzie on Thursday, January 22, there are two key points of contention between Kwesi Arthur and Ground Up Chale.

1. Contractual Obligations and Album Releases

Amable explained that Kwesi Arthur’s contract with Ground Up Chale had been renewed specifically for the release of his album, “Son of Jacob.” However, following the album’s release Kwesi Arthur reportedly Walked away from his relationship with the label and sought external representation.

He allegedly informed Platoon, a music distribution and rights management company, that he was the sole owner of the “Son of Jacob” project despite knowing it had been released under the label, a move that also involved financial transactions.

Amable emphasized that this created friction as the label maintains contractual rights over works released under its management.

2. Image and Material Rights Dispute

The second issue centers on Kwesi Arthur’s use of previously created materials. Amable clarified that circulating claims about the rapper’s image rights are inaccurate.

The real dispute he explained stems from Kwesi Arthur’s use of materials from past projects produced under Ground Up Chale for his latest Project “Redemption Valley.”

Despite being cautioned by the label against using these materials, Kwesi Arthur allegedly proceeded with the release without obtaining proper clearance.

Amable stressed that his comments were solely factual and devoid of threats, aimed at clarifying the label’s legal position.
